A Matter of Priorities
After reflecting on the decision by council to send BOTH Lanman and Sauceda to Austin at taxpayer expense to pursue four million dollars of debt for the city, I am left confused. Where is the sense of priority with our elected officials? We elect them to serve Marfa with all the wisdom they can muster, and this is the best they can do?
For two years Sauceda and Lanman, along with council, have failed to pass a budget in time or raise taxes to fund the city. This summer was misspent by Lanman's pursuit of a landfill instead of doing budget work along a schedule recommended by the state comptroller. The state appoints the mayor of a city as the Budget Officer and gives this person ultimate responsibility for adopting and managing the city's budget. Sauceda is unaware of tax hike laws and botched any attempt to raise taxes this year. Lanman is so offensive that he told a councilmember to "buzz away" before a crucial last-ditch special meeting of council to deal with all the city's finances.
Both Lanman and Sauceda failed to familiarize themselves with laws regarding adoption of a budget. One could possibly forgive Budget Officer Lanman when he blew the budget in his rookie year, but this was his second time around. There is no excuse this year for Lanman or our professional and experienced administrator. At the public notice for the budget on the 28th of September, I asked council to make motions and vote on petitions being made by various groups for inclusion in the budget. Lanman and Sauceda reprimanded me saying that this was a public hearing and that no action could be taken. I read the Local Government Code again on budget public hearings and learned that not only is action allowed, it is required! Marfa was legally bound to take action on the budget at the end of the hearing. They had quorum. All they lacked was a motion, a second and a vote--that and basic competent knowledge of the law. The opportunity slipped away due to a lack of familiarity with governing laws. I firmly believe that if they had read the law, we could have passed a budget before the year began. I also believe that if Lanman had not insulted Chavez, quorum would have been possible at the Friday meeting on the 29th allowing for a possible increase in property taxes. The incompetence of Sauceda and rudeness of Lanman has seriously hurt this city and its employees.
So here we are on the verge of November 2006, and we have not had a reading and discussion of the budget since mid-September. The next meeting of the council is not until November 14th. Council tabled work on the budget at the recent meeting on recommendation of Lanman and Sauceda. Sauceda claims that he has not prepared an updated revision of the budget to reflect huge changes to our financial situation including loss of anticipated tax revenue, loss of gas company revenue, elimination of bogus Stone Garden funds, and the proposed reductions demanded from each department head. He has done nothing since the first draft of the budget in August. Budget Officer Lanman has done nothing at all on the budget.
Now council is sending them on a wild goose chase to Austin to find the golden egg of easy borrowed money. Shame on you council. First things first. Address the financial emergency facing the city. Get your ducks lined up. Balance your checkbook. Prepare a budget and stick to it. Pay your bills on time. Compensate emergency personnel appropriately. Council has no business authorizing the city to take out a huge debt while they allow Sauceda to mismanage the finances and Lanman to ignore his budget duties. This is unwise and irresponsible.
Council should take notice that at least 57 people don't trust Sauceda with a five dollar bill for EMS. We sure don't trust him with four million dollars! Please stop this nonsense. After you have addressed the current financial crisis, you have an obligation to provide quality water and sewer service. Public works generates a surplus of $250,000 a year that is robbed to pay general administration expenses. We already have the money to pay for improvements to public works in the public works revenue. Borrowing four million dollars while ignoring all of the city's finances is foolish.
Let me offer an alternative way of approaching this situation. First we need to define the problems. We need a prioritized list of problems with our water system and wastewater system. For each of these problems, we need to come up with three different options for improving the problem. These could range from stopgap emergency patches to moderate improvements to widescale replacements. Council should debate these tradeoffs and make choices based on recommendations from Robert Silva and the financial impact. Then, one problem at a time, we should put these projects out for competitive bid. Our first priority should be funding these Public Works projects from the $250,000 in "profit" generated by Public Works. Debt should not be taken lightly. Our problems did not happen overnight and they will not be fixed overnight. A fast-buck quick-fix solution involving big-debt sounds sexy but is irresponsible. A long-term plan based on priorities and fiscal responsibility and patience is the proper way to run a government.

Chasing after easy money from lenders without a comprehensive plan is a recipe for disaster. This administration likes to play favorites. There is a favorite architect. There is a favorite auditor. There is a favorite engineering firm. I get worried when I see our fiscally irresponsible mayor and administrator get their hands on a large pile of money with no clear plan but prepared to dole money to favored vendors. This type of process is ripe for corruption and mismanagement in any government situation. If we have a lot of easy money at hand, we will spend it easily and pay it back with difficulty. If we recognize that we should spend no more than part of the surplus generated by public works, then we will act more frugally and more responsibly out of necessity.
Council, please look at the big picture. We are depending on you to manage things effectively. Citizens, please talk to our elected councilmembers. These are friends and neighbors that most of you have known all your life. These council members asked for our trust, and we give it to them. Please let them know how you feel about our finances. Are they doing a good job? I trust that they will respond to citizen feedback. As it is, they seem to be following the lead of Lanman and Sauceda, and we know where that road leads: an even bigger financial mess than the one we are in now. Beware the quick fixes based on easy debt. It is a matter of priorities.

Let us examine the makeup of our council. Oscar is pro-flo and will protect him at any cost. Consider, too, that an investigation of city management policies could extend back to his regime and uncover something. Oscar wants to be on the gas board. We don't think he will run for Mayor. Another run at City Council? Sure, why not. He's got Flo and Mary Williams (and the ubiquitous Gloria until May). I have heard Mary was going to resign but Lorina beat her to it. Mary has eroded her credibility totally, so don't call her. She won't do anything, she doesn't have the stomach. If Homecoming resigns, David has Bob Schwab picked as a replacement, but surely Oscar can trump that. Oscar continues to empire build. Don't call Oscar, it doesn't work. He has his own agenda. By the way, he knew about the $4 million loan. Call Gloria? And be subjected to some racist diatribe? Leo will continue to be a thorn in the side, but he is outgunned.
Why did the council decide to send both the Floie and the Davie to Austin wouldn't one of the two be able to do the job. loan one of them a tape recorder if they can't take notes on more than a "post-it-note" What? probably an extra $750 of taxpayer money so the boys can party together. In order to put a $4million debt on the shoulders of us and the future folks of Marfa.

So many of us would be floating along in the belief the "all-is-well" at city hall. Who would have known of the shenanigans of this administration and the ineptness of many in the council. New appointments to the council ! how about the mayor showing he can appoint more than a scherzando.
The council didn't decide to send. Flo and Dave decided to send, as in all the other trips they have taken. They just tap into the till, get advance travel money, don't ever bring receipts back. Nice gig if you can get it. This might be a good time for an open record request. When they get back, ask for the hotel receipts, credit card receipts, etc.

Oh,please - let it be so! They are supposed to take an ocean cruise, I believe in November. What will this all mean? Wait, can it be that she was scheduled to fill the vacancy only to pass the budget and then leave, and surprise, the budget wasn't able to be voted on because Oscar stormed out? Wait again, Oscar was in on her being the replacement and he's the one who derailed the budget and tax rate being approved. So he would have known about her leaving in November and would've stayed to work the set up if she was put it as a shill. Maybe her cruise isn't til the end of November so she can STILL approve the budget on November 14 and resign, pleading fatigue and emotional anguise,and make the cruise. Oh, this is all to Machiavellean for me!
The last City Council meeting was on the Regular Meeting day and time, but posted as a Special Meeting. A mistake. But City Attorney said meeting could be held as a Regular Meeting. As I understand this, a Regular Meeting needs 3 Coucilpersons and a Special Meeting needs 4 Councilpersons. There were 4 Council there, then there were 3. Then the budget was tabled till a 'full Council' could attend. Maybe there wasn't anything on the agenda, besides the budget items, that would be expected to be contested by anyone from the Special vs Regular Meeting, 4 Councilpersons perspective. But if someone contested a 3 Councilperson budget decision on a Special Meeting basis... Maybe we are not being told the whole truth about the City Attorneys remarks about this. What is 'a full council'? 4 or all 5 of the Councilpersons?
I think I have read that a quorum consists not of the people present but of the positions existing???
Mayor and Administrator will be in Austin for water loan money the first and second. Also on the first and second are public hearings for a Rural Transit District, Rural Transportation Plan for an inter-city bus system that could cover 5 rural counties and more. A meeting 11/1 830a-1230p at Sul Ross and a meeting/presentation in Marfa at City Hall 11/2 530p. Anyone from the City to represent Marfa going?
Uh-humm. Idle minds are the devil's playhouse. I've seen too many sale pending signs to make snap judgements about outcomes. We should proceed as though no such hopeful event as her leaving, whether by home sale or sunken sail, might happen. As for resignations, she will resign her seat on P&Z first (she has made too few meetings there to legally remain.) Better to hope for legal intervention on the "conflict of interest" issue posed by her also holding the council position. Big "O" simply isn't clever enough at intriguing on the scale suggested. The pressure must stay on the head if the body is to wilt. They already have their replacements waiting in the wings for any eventuality which leaves a vacancy. If "numero uno" is allowed any respite he could heal his now bleeding guts. We're doing it right for the moment, folks. Let's remain focussed on stamping out the whole serpent.

Wanna see what we city taxpayers paid for when Lanman (and girlfriend as I understand it) went to the NAD Bank/BECC annual conference in June (about $1,000 what with hotel bills and per diem, gas money, etc)? read the transcript, see it for yourself. Today I went to City Hall and had the voluntary donations removed from both my account and that of my dad (with his approval). It's not that we don't support EMS and the Fire Department; we do. In fact we plan to give an annual donation to both entities...just not through the coffers of City Hall. Jesse Pena of EMS told me that they have a special account of monies from the tobacco settlement, the hospital district, some grants, etc. This account is not through the City and the money is to be used toward the purchase of a new ambulance; it cannot be used for salaries. Gary Mitschke of the Fire Department told me that they have a special account that is not through the City and they are trying to come up with enough money for a new pumper. Before I make any donations I will once again verify this information with Jesse and Gary. I definitely want the EMS staff to receive an increase in salary, but I believe that it is ludicrous for this increase to be based on voluntary donations tacked onto the utility bills. What kind of financial planning is this anyway? I hope that all who have had their voluntary donations removed from their utility bills will give generously to the EMS and Fire Department special accounts.
Dawn, I applaud your creative solution to this conundrum. I too have thought about pulling my voluntary contribution but don't want to punish emergency services. Please let us know what you learn and how to go about making these donations. I will gladly cut them an annual check instead.
Why doesn't somebody just ask Gloria about her plans? Next time you see her, just ask her. She is a public servant. We deserve to know her level of committment. I don't think there was a nefarious plan. Simple people make simple plans. I asked Lupe Devine why she wanted Gloria. She explained that Gloria was the highest runner-up in the recent election. She was the loser with the most votes. I asked her if she thought Gloria would be more helpful on financial issues than Carl. She dodged the question at first saying that council would be fine with Gloria's participation. I pushed the question and she finally replied that she thought Gloria's financial contribution would exceed Carl's. Go figure.
I heard another theory that is just rumor, but what the heck. Gloria's husband made all the signs for las tres mujeres and only Mary and Lupe got elected. Mary and Lupe put Gloria on council for political payback. I never liked that tres mujeres campaign. I don't understand Oscar's support of Gloria.
Such is the nature of small-town local politics. Long memories. Lots of drama. One just hopes that the amount of energy put into the actual issues is at least equal to the amount put into the drama.
It really is an interesting time to watch these maneuvers. It would be more fun if the stakes were not so high. Failure to pass budgets and tax hikes combined with a million dollar landfill and four million dollar water debts and illegal budget changes and a disintegrating EMS makes Dave's three thousand dollar door and Flo's three-day work week look like peanuts.
On the bright side, think about how much damage Flo would do if he actually showed up for a full week! Maybe we should give him two days travel time each way! I'd like that.
Keep the faith. Lawsuits won't help anything. Attending council meetings and expressing your opinion to council will make a difference. Council really does want to do what is best for Marfa. They just need to hear other opinions besides those of "Staff will look into it" Sauceda and "Fastest gavel west of Alamito Creek" Lanman.

read here. Kudos to Dawn. I'll follow suit today. Rob is right both about futility of litigation and about citizen participation. Without it Rob is seen to stand alone. And we all know this is not the case. This will most likely come down to waiting it out 'til election time, which gives plenty of time to get the silent majority of this community involved.

According to the 2006 approved city budget, the Fire Department Fund has two sources of revenues, grants and the surcharge with 0 in the grants. Their expenditures from this account cover supplies, maintenance, utilities, travel
dues, training, and capital outlay.
The City EMS budget has revenues from donations, RAC funds (is this tobacco settlement?), Medicaid NHIC, Medicare, Ambulance Service Charges and the Surcharge. Expenses cover salaries, benefits, supplies, utilities, maintenance of building and equipment, travel, training and capital outlay.
Remember when Keller quoted the state law to Flo and Dave and Council the other night very adamantly expressing that the voluntary contributions were being done illegally? Well, get this. On the agenda, it said "pass a Resolution"- it didn't say grant an increase to $7.00 - it said, in flo's inimitable way of obfuscating on the agenda, pass a Resolution. The Resolution cannot be located. The Resolution stating the amount was not in council's packets. Flo was asked for the Resolution and he is supposed to be getting a copy for the requester. But the pay raise for the EMS granted through this increase in surcharge is already being put into EMS pay checks. The law doesn't allow the surcharge to be used for salaries. GET IT, FLO????
Furthermore, another "don't the Mayor make you proud" story. A citizen was in City Hall yesterday discussing something with Flo and the Mayor stormed in and was worked into such a lather in rage that he exited and reentered Flo's office several times, pointing his finger and shouting at said citizen. Another thing he is doing against proper procedure is individually polling BOA members on a certain issue to see how they intend to vote. That's what I heard.
According to calculations, Flo is making 43.33 per hour and the EMTs make 8, well, did they get a raise to what?
Some fun budget figures:
The Fire Department is funded entirely from the surcharge, that is the only revenue in their budget. Actual 2004-2005 revenues were 10,092,2005-2006 were 9,800, but for the proposed 2006-2007 (and this comes from the October 2005 approved budget)jumped to 33,000. For the first time, this left them with the substantial overage of 15,944 which under pressure Flo has agreed to put in a special account for them for grant matching monies. I can't remember hearing how this
amount jumped about a third. Their expenses went from actual 9,533 to 17,056.
For EMS, actual revenues (gifts, tobacco money (RAC funds?), Medicaid/medicare,
ambulance service and ems surcharge of 10,092 totaled to 76,864. Proposed: EMS surcharge of 33,000 total revenues of 128,774. Gifts, RAC funds (tobacco?), and Medicaid stayed the same, but medicare went up some and ambulance charges doubled, and of course the surcharge tripled.

Salaries went from 115,680 to 137,203. Did somebody tell me the city was plugging in money into the EMS and Fire Department surcharge??? We know this: Flo is illegally using the increase in the surcharge to subsidize salaries, which is illegal.
The expenses went from actual 174,835 (-97,971) to proposed 202,813 (-74,039). What?
Believe Fire Dept get $5000 from the county every year.
Remember when Tres Mujeres were running to, what was the slogan, "take back our city?" Well, there they are, all three of them, and here we are, with the same out of control city government, the same fiscal mismanagement, the continued abuse of city assets, the same dereliction of duties, the same ignorance of parliamentary procedure....What has been taken is the voters, for the big ride.
