Another Missed Meeting
City Council failed to meet on September 7 due to lack of quorum. Oscar Martinez and Lupe Devine were not present. This was a special meeting on the budget of the current fiscal year and the next fiscal year which starts in three weeks. I updated the graphic that shows successful and failed meetings. You can find it on the sidebar to the right. Council has successfully met for 61 percent of their scheduled meetings this year.
The planned meeting schedule for the rest of September is as follows:
Tuesday, September 12: Regular meeting
Thursday, September 14: Special meeting on budget and taxes
Thursday, September 21: Special meeting on budget and taxes
Thursday, September 28: Regular meeting
City Administrator Sauceda hopes to have council approve the 2006/2007 budget at the regular meeting on September 28th and plans to post this with 15 days notice as required. Let's hope council can make the meetings. This is his only shot at getting the budget approved before the fiscal year starts October 1st. Last year, the budget was not adopted until October 29th!

Topics include an ORCA Texas Community Development Fund grant, EMS variance, golf, 2005-2006 auditor appointment, reposting of the public nuisance described here earlier, and July expenditures and August payables.

Statutes may leave some breathing room on this drop dead October 1 deadline. Need to check on this. Flo keeps telling people that if he can't get a quorum to approve the budget and tax rate, the law says it is automatically approved in 20 days. Nobody (but Monte Akers) seems to be able to find this statute unless he is mistakenly referring to the budgt process of the appraisal board.
Please forgive me but the specter of that 2006 retyped budget which smacks of overspending the original(haunts me). Here is something from Attorney General Opinion May 18, 2006: quote
We cannot find any judicial decisions that discuss what constitutes "municipal purposes" for purposes of section 102.010. But see Gardner v. City of Hamilton, 536 S.W.2d 422, 424 (Tex. Civ. App.--Waco 1976, writ ref'd n.r.e.) (stating, for purposes of a statute authorizing municipalities to exercise the power of eminent domain to acquire land for municipal purposes, a municipal purpose is one that "promotes the comfort, convenience, safety, and happiness of the citizens of the municipality rather than the welfare of the general public"). Moreover, we cannot conclude from the face of the statute that section 102.010 would allow a municipality to amend its budget to spend funds that exceed the appropriations that were approved in the previously passed annual budget.

It is stated that Flo would like to adopt the 2006-07 Budget at Sept 28th Meeting. I can't see that happening since he is concern
about amending the 2005-06 budget before adopting the 2006-07 budget.........Seems like he pulls figures from somewhere and blows smoke to get them justified. His presentations are soooooooooo smooth.I hope the council is able to see this and even if he is a "Mexican" not approve budget until he can give straight answers to questions. And not let him "I'll have to get with you later on that"
